Swiss to make Polanski announcement Monday

Switzerland will make an announcement Monday about the extradition of Roman Polanski to the United States for sentencing on a charge of unlawful sex with a 13-year-old girl, the government said.

Justice Ministry spokesman Guido Balmer declined to confirm that a decision had been made, or what it might be.

The government said only that Justice Minister Eveline Widmer-Schlumpf will hold a news conference in the capital, Bern, at 2 p.m. (1200 GMT; 8 a.m. EDT) "on the matter of the Roman Polanski extradition decision."

Lawyers representing Polanski declined to comment before the Swiss announcement.

Open-and-shut case vs. secrecy

Court records sometimes are sealed for legitimate reasons — to keep a witness' private medical information out of the public eye, for example.

But too often, records are hidden away for spurious reasons — to render judges' or lawyers' divorce records private, for example, while the proceedings of ordinary people remain public.

A legal effort under way to keep secret the testimony of Cook County Commissioner Jeffrey R. Tobolski in a lawsuit involving alleged hiring improprieties strikes us as being in the second category. The judge should refuse to play along.

Arnold Elected to National Academy of Sciences

Frances H. Arnold, a professor of chemical engineering and biochemistry at the California Institute of Technology, has been elected to the National Academy of Sciences. The Academy recognized Arnold for integrating molecular biology, genetics, and bioengineering into industry, including research in protein design and new biocatalysts.

Danish electronics maker Bang & Olufsen fires CEO over poor results

The board of high-end electronics maker Bang & Olufsen A/S on Thursday fired chief executive Torben Ballegaard Soerensen, citing poor earnings.

The announcement came a day after the Danish company, known for its premium stereo and TV systems, downgraded its full-year earnings forecast because of a slump in sales.

Bang & Olufsen said it expected its pretax profit in the current fiscal year to be between 360 million-400 million kroner (euro48.3 million-euro53.7 million; US$71 million-US$78.8 million), down from an earlier estimate of 570 million kroner.

The company's fiscal year starts on June 1.

Net income dropped 61 percent to 49.3 million kroner (euro6.6 million; US$9.7 million) in the June-November period, from 127.4 million kroner in the same period a year earlier.

"The recent years' disappointing development in the group's overall turnover, and the regrettable downgrading of the company's result, has contributed to the board's decision to make changes within the company's top management," Bang & Olufsen said in a statement.

It had not yet found a replacement for Ballegaard Soerensen who was dismissed "with immediate effect."

The board said the company should focus on its core business of quality and upscale audio and TV products. In recent years, the company has broadened its product range to include high-end cellular phones and car stereos.

Cambodia court rejects opposition leader's appeal

PHNOM PENH, Cambodia (AP) — Cambodia's top court has rejected an appeal by the country's exiled opposition leader, who was sentenced to two years in jail for uprooting border markers with Vietnam.

Sam Rainsy, who is living in exile in Paris, was convicted in January 2010 for leading a political protest to pull up the border markers to garner public support and boost his claim that Vietnam is encroaching on Cambodian territory.

Judge Khim Pon rejected his appeal Tuesday, saying the verdict reached earlier by a lower court was valid.

Rainsy was also sentenced separately last year to 10 years in prison for spreading false information about the border dispute.

Critics say the issue is an example of the intimidation of opponents by the government of Prime Minister Hun Sen.

Cuba's Castro Looks Healthy in New Video

HAVANA - Fidel Castro looked alert and healthier during an hour-long interview taped and aired on Cuban television Friday, responding to rumors of his death with a defiant "here I am." In the first video of the ailing 81-year-old seen in more than three months, a pale but upbeat Castro wore a red, blue and white jumpsuit with "F. Castro" in small block letters.

The Cuban leader stayed seated the entire time, spoke slowly and softly and didn't always look the interviewer in the eye. But he appeared to be thinking clearly.

He warned that the Bush administration could go to war with Iran, and bemoaned the high cost of the war in Iraq, but provided no new details about his health, except to say, "Well, here I am."

Mocking persistent rumors of his death that have circulated in Miami and elsewhere in the United States, he said "they say 'I was dying' and 'if I die' and 'I will die the day after tomorrow' or something."

"Nobody knows the day they are going to die," he said.

Early on, Castro often trailed off mid-sentence, and needed some prompting by the interviewer. He had bags under his eyes, sunken cheeks and his thin gray beard looked as wispy as ever. But he appeared to get stronger and more comfortable as time passed.

Officials broke into regularly scheduled programming only minutes earlier to announce that a "conversation" with Castro would be shown.

Castro mentioned the price of oil and the value of the euro against the dollar, evidence that the video was recorded Friday, as Cuban officials said.

"Yesterday the euro was at $1.41. Oil I think about $84 a barrel," Castro said.

He also held up a copy of the new book by former U.S. Federal Reserve chairman Alan Greenspan. At one point he quoted it, reading excerpted passages in very large type instead of using the book itself.

He also spoke about a wandering essay he wrote that was published in state media on Wednesday.

Castro has not been since in public since July 31, 2006, when he announced that emergency intestinal surgery was forcing him to step down in favor of a provisional government headed by his younger brother Raul.

As he recovers in an undisclosed location, Castro's condition and exact ailment are state secrets, though he wrote in one of his essays that he had undergone multiple surgeries, at least one of which went poorly.

For months, official photographs and videos showed Castro's recovery, but no new images had surfaced since he appeared in an interview on Cuban television June 5.

Earlier Friday, Vice President Carlos Lage told reporters that the essays Castro has signed every few days since late March are evidence that his health is strong.

"Fidel continues to recuperate. It's a productive recuperation as we can see in the press," said Lage, apparently referring to the publication in state newspapers of Castro's "Reflections of the Commander in Chief."

Also Friday, Foreign Minister Felipe Perez Roque said that "Fidel is recovering with discipline and I think that he's having a productive work period - reading, studying, writing and keeping up with and participating in the country's principal decisions."

Castro had suggested he can't be bothered to trim his beard or comb his hair - possibly explaining why so few official images have been released.

In Venezuela, friend and ally President Hugo Chavez announced that Castro was speaking on Cuban state television.

"A long life to Fidel and the Cuban revolution," the Venezuela leader said in a speech.

Earlier while traveling in Brazil, Chavez said Castro was "close to death" but underwent several operations and has regained weight.

Castro had "three operations, and he's 81, imagine that. They changed almost all the blood with transfusions. Fidel is alive because he is Fidel," Chavez said.

Late Night TV Hosts Back After 2 Months

Late-night TV hosts returned to the air Wednesday after a two-month hiatus, showing support for their striking writers, plenty of creative stretch marks _ and at least two scruffy beards.

David Letterman walked onstage amid dancing girls holding picket signs supporting striking writers. His writers are back on the job, but NBC's Jay Leno and Conan O'Brien and ABC's Jimmy Kimmel returned without theirs.

Leno, however, offered a monologue that included jokes he said he had crafted beforehand. Whether that violated rules of the striking Writers Guild of America _ to which Leno belongs _ was not immediately clear.

"We are not using outside guys," Leno said in the monologue, according to a transcript provided by NBC. "We are following the guild thing ... we can write for ourselves."

The union said Wednesday it was withholding comment until it spoke to Leno about his show, which, like the other returning programs, was laden with references to the strike.

The walkout, Leno joked, "has already cost the town over half a billion dollars. Five hundred million dollars! Or as Paul McCartney calls that, `A divorce.'"

Filler was immediately evident on the shows without writers. O'Brien, sporting facial growth to match his red hair, showed off Christmas cards, danced on his table as his band played the Clash's "The Magnificent Seven" and tried to see how long he could spin his wedding ring on his desk. Leno took questions from his audience.

There was also plenty of free on-air promotion for the guild's cause.

"The writers are correct, by the way. I'm a writer ... I'm on the side of the writers," Leno said.

"I want to make this clear. I support their cause," O'Brien said. "These are very talented, very creative people who work extremely hard. I believe what they're asking for is fair."

Letterman, who had grown a mostly white beard, brought writers on to recite a top 10 list of their strike demands. They included "complimentary tote bag with next insulting contract offer" and "Hazard pay for breaking up fights on `The View.'"

"You're watching the only show on the air that has jokes written by union writers," Letterman said. "I hear you at home thinking to yourself, `This crap is written?'"

Guest Robin Williams teased Letterman unmercifully about his beard, alternately comparing him to Gen. Robert E. Lee, a rabbi and an Iraqi mullah.

On the eve of the Iowa caucus, presidential politics intruded: Republican Mike Huckabee appeared on Leno despite his apparent confusion about the strike and a bid by picketers to keep him away, and Democrat Hillary Clinton taped a cameo introducing Letterman.

"Dave has been off the air for eight long weeks because of the writers strike," she said. "Tonight, he's back. Oh, well, all good things come to an end."

Huckabee said he supports the writers and did not think he would be crossing a picket line, because he believed the writers had made an agreement to allow late-night shows on the air. But that's not the case with Leno; "Huckabee is a scab," read one picket sign outside Leno's Burbank, Calif., studio.

The writers guild urged Huckabee not to cross their picket line after he flew out to California. But Huckabee appeared on Leno, even showing off his electric guitar playing with the band.

"Huckabee claims he didn't know," chief union negotiator John Bowman said. "I don't know what that means in terms of trusting him as a future president."

For fans of the late-night hosts, the controversy was secondary to seeing their favorites again. Chuck Gunther of Grand Junction, Colo., stood on a sidewalk outside of Letterman's New York studio on a frigid night hoping to get into the audience.

"When Dave is live, it's fresh and new every night _ instead of watching reruns of `Seinfeld,'" he said.

Letterman had writers because his production company, Worldwide Pants, struck a separate deal with the guild. The deal also allowed writers to return to Craig Ferguson's "Late Late Show" on CBS.

Picketing writers outside of O'Brien's studio in New York's Rockefeller Center said they were hoping to encourage people not to appear on the shows where writers weren't working. Michael Winship, president of the WGA East, said he expected Letterman's "Late Show" to be a "bully pulpit" for striking writers and their issues.

Leno's staff writers, who regularly picket at one of the gates to NBC studios, did not show up on Wednesday, instead walking the line at NBC Universal, the guild said. Writers insist they're demonstrating against NBC, not Leno, who was supportive of his writers in the strike's early days.

"It must be difficult for them to picket their own boss," said Allan Katz, a veteran sitcom writer. "Probably Jay Leno understands."

Besides depriving the nation of punch lines, the two months of reruns have been devastating for the networks _ particularly NBC. Late-night leader Leno is averaging 4.4 million viewers this season, losing a quarter of his audience from last season. Before the strike, his audience was off 10 percent, according to Nielsen Media Research.

Letterman's average of 3.6 million viewers is 15 percent off last season. Before the strike, his viewership was down 9 percent. Leno's audience was obviously far less interested in reruns or _ even worse for NBC _ decided to sample Letterman instead.

Kimmel's audience of 1.8 million viewers is slightly up from last season, because it follows "Nightline," which has been making fresh shows.

O'Brien's audience is down 29 percent from last season and he's been running virtually neck and neck with Ferguson: O'Brien has 1.8 million viewers, Ferguson 1.7 million. Now Ferguson returns with writers and O'Brien without.

How big the advantage might be for CBS likely depends on how long the strike lasts. At least at the beginning, the writer-less shows may draw viewers curious to see how the hosts respond.

The CBS programs will also probably have bigger-name guests. The Screen Actors Guild has urged its members to appear with Letterman and Ferguson. It's unclear whether Hollywood's glitterati will be willing to cross picket lines for face time on national television.

Comedy Central's topical nightly comedies, "The Daily Show" and "The Colbert Report," will return Monday without striking writers.

GOP Rivals Argue Who's Most Conservative

ORLANDO, Fla. - Front-runners Rudy Giuliani and Mitt Romney were forced to defend their conservative credentials by their campaign rivals Sunday night in the sharpest debate so far of the Republican presidential campaign.

"You've just spent the last year trying to fool people about your record. I don't want you to start fooling them about mine," Sen. John McCain jabbed at Romney, the former governor of Massachusetts.

Former Sen. Fred Thompson turned Giuliani into his target, saying the former New York mayor supported federal funding for abortion, gun control and havens for illegal immigrants. "He sides with Hillary Clinton on each of those issues," he added, referring to the New York Democrat who leads in the polls for her party's presidential nomination.

The debate's early clashes prompted former Arkansas Gov. Mike Huckabee to say he wanted no part of a "demolition derby." Instead, he said he was running for the White House to "protect the sanctity of human life."

The debate was the eighth of the campaign, and the first since Sen. Sam Brownback of Kansas dropped out of the race, citing insufficient funds. The remaining rivals stood on a stage at a resort 10 miles from Disneyland, fielding questions for 90 minutes at an event broadcast by Fox News Channel.

The debate unfolded about 10 weeks before voting begins for Republicans. The leadoff Iowa caucuses are scheduled for Jan. 3, 2008, and the approaching primary season has coincided with a distinct increase in rhetorical combat among the contenders.

The first question went to Giuliani, asked whether he was more conservative than Thompson. "I can't comment on Fred," the former mayor said.

He then added that he had brought down crime, cleaned up Times Square, cut taxes and eliminated the city's deficits. "I think that was a pretty darned good conservative record," he said.

End of an icon: JWT folds up shop in Chicago

Rack it up to incompetence.

On Friday JWT North America President Rosemarie Ryan came to Chicago to tell the shop's 50 remaining staffers that JWT/Chicago will shut down forever within the next 60 days, leaving the last vestiges of its Chicago staff without jobs.

It's a stunning blow to the Chicago ad industry, which has seen almost nothing but one setback after another in recent years, and for JWT in particular, which for many years could lay claim to operating one of Chicago's largest advertising shops. At its peak, JWT/Chicago's staff numbered more than 800 in the 1980s.

But JWT/Chicago has been headed nowhere but down in recent years as the agency's top brass in New York dispatched round after round of useless managers to Chicago who were ill-equipped to deal with the shop's declining fortunes.

The last bombshell was Northfield-based Kraft Foods, which pulled nearly $200 million worth of business from the agency two years ago.

JWT/Chicago also has been without any on-site leadership for nearly two years, even as Ryan maintained she was managing the shop from New York. Amazingly, Ryan, unavailable for comment, told Advertising Age she had no idea why JWT/Chicago failed.

If nothing else, that sort of remark speaks to the woeful inadequacy of current leadership.

For several years it has been Ryan's responsibility to know why JWT/Chicago was failing -- and do something about it.

But even after the agency lost its Kraft business, Ryan seemed at a loss about what was needed to get JWT/Chicago back on track. Instead she kept insisting the Chicago shop would muddle through under her guidance.

It didn't. Now there is nothing left.

Obama offers support to Uganda following bombings

President Barack Obama spoke with Ugandan President Yoweri Museveni on Monday to express his condolences for the loss of life in twin bombings that killed dozens of people.

White House spokesman Robert Gibbs says Obama offered to provide any support or assistance needed in Uganda. A Somalia-based militia with links to al-Qaida has claimed responsibility for the bombings that killed 74 people during Sunday's World Cup final. The U.S. State Department has declared the al-Shabab militia a terrorist organization.

Stocks open higher on Wall Street

Stocks moved slightly higher in early trading despite a handful of mixed earnings reports.

The toymaker Hasbro Inc., like many other companies, says its third-quarter earnings rose as it cut costs, but reported that its revenue fell. Gannett Co., the largest U.S. newspaper publisher, also had a profitable quarter even with another big decline in ad revenue.

Investors are anxious to see if companies from a broad range of industries fared better in the quarter than banks did.

In the first few minutes of trading, the Dow Jones industrial average is up 14.21, or 0.1 percent, at 10,010.12. The Standard & Poor's 500 index is up 1.80, or 0.2 percent, to 1,089.48. The Nasdaq composite index is up 4.06, or 0.2 percent, at 2,160.86.

Death toll in India boat accident rises to 52

Officials say the death toll from a boat accident in northern India has risen to 52 as rescue workers continued to recover bodies.

The crowded vessel capsized on the Ganges river Monday. Magistrate P.K. Misra says the boat was carrying at least 100 people, most of them women and children. The load was well above its capacity of about 30 people.

Surendra Srivastava, a state police spokesman, says rescue workers have pulled out 52 bodies as of Tuesday morning.

The accident took place in Ballia district in Uttar Pradesh state, 250 miles (400 kilometers) southeast of capital Lucknow.

Seahawks down Raiders

SEATTLE Dave Krieg left his mistake-flawed season behind,directing the Seattle Seahawks to a 23-17 victory Sunday night overthe Los Angeles Raiders, whose playoff hopes were severely damaged.

The loss stymied the Raiders (8-7) in their bid to clinch an AFCwild-card berth.

Both the Seahawks (7-8) and the Raiders remained mathematicallyalive - although longshots - for the playoffs.

The Raiders had a three-game winning streak broken.

Bobadilla to miss at least 1 game

Cubs' Wood out until Sept. 1 with injury to right shoulder

Birth control shots tied to long-term weight gain

Women who gain weight rapidly after starting birth control injections appear to be more prone to long-term weight gain, researchers have found.

Women whose weight increased by 5 percent or more within the first six months of taking the injected contraceptive Depo Provera gained an average of 24 pounds over a three-year period, researchers from the University of Texas Medical Branch at Galveston found.

These so-called "early gainers" represented about 25 percent of women who took Depo Provera. The rest experienced little to no weight gain.

Early gainers were more likely to be women who had a body mass index under 30, already had children and those who reported an increase in appetite after being on the shot for six months.

The study appears in the August issue of Obstetrics and Gynecology.

Peale's Wife Carries On Gospel and Empire

At a breakfast meeting of DuPage County business leaders lastweek, the question was posed: "How many of you have read The Power ofPositive Thinking?"

About 80 percent of the estimated 300 in attendance raised theirhands.

"Great! That's great!" said Ruth Peale, widow of the man whopenned that ground-breaking self-help book in 1952 - Norman VincentPeale.

While it may conjure up '50s business images of martinis and menin hats, more than 40 years after its introduction, Power still hasits aficionados. With a reported 15 million copies sold globally, itholds the record for the top spot on the New York Times best sellerlist (98 weeks). With about 150,000 copies sold a year, it remains asteady performer.

Combining self-help and religious faith, the book hasinfluenced business circles for decades.

Norman Vincent Peale died almost a year ago, on Christmas Eve,1993. His 88-year-old widow now presides over his publishing empire,which includes the magazine Guideposts, a publication that claims torival Time magazine with a circulation of 3.8 million readers.

After an address to the Oak Brook Business Executive Club lastweek, Ruth Peale said she believes the book's attraction amongbusiness people, though less than it once was, still continuesbecause "business people have a lot of problems today."

"They have problems in melding a staff together, problems ofbeing jealous and dealing with jealousy, from the bottom to the top,"she said. "The drive to succeed is enormous today."

She said business people also face "tremendous ethical problems- decisions that have to be made to stay competitive."

"I think Norman gives them a message that they can think about,that brings them to a place where they can make those decisions," shesaid.

Two Chicago area firms, Crouse Communications and the DuncanGroup, are tapping into Peale's continuing popularity through a newPBS production, "Positive Thinking: The Norman Vincent Peale Story."

The program, airing locally at 9 p.m. Tuesday on WTTW-Channel11, follows Peale's life, beginning with his boyhood as the son of aMethodist pastor in Bowers ville, Ohio. The program chronicles Peale's career as an insecureDutch Reformed Church minister who attained enormous influencethrough his close associations with the business and political powersof the mid-20th century.

He was particularly close to Richard Nixon. The formerpresident told the program's producers, in one of his last interviewsbefore he died, that Peale's popularity can be uncovered in a simplemessage: "No matter how tough it seems, when you think everything isjust going to pieces and nothing can be done about it, you've got tothink positively - there's a way out."

Today, young executives are more likely to read "`MinuteManager" type business books than Peale, experts said. However, manybusiness books contain nuggets of Peale, and many older topexecutives have read Power.

Today, Peale's empire continues, with his wife chairing theboards of its various nonprofit entities. She has been described asthe business brains behind the Peale movement.

Based in Pawling, N.Y., the Peale Center for Christian Livingholds seminars on positive thinking and runs an educational programfor children called "Positive Kids," used in 9,000 American schools.In addition to Guideposts, it publishes another magazine called PLUS.

In the works: A third magazine, Positive Living, will belaunched in January; efforts are under way to form a nationwideorganization of small group meetings to practice positive thinking; anew audiotape series from a library of 800 to 900 sermons, and therelease of some of Peale's unpublished writings.

Boeing accelerates production of 747, 777 models

Boeing Co. will speed up production plans for its 777 and 747 models in anticipation of greater demand from commercial airlines in a couple of years.

Both are wide-body planes capable of carrying more than 300 passengers and flying longer routes. Several Asian airlines have ordered the planes, which are also more fuel-efficient than other aircraft models.

Asia experienced a smaller dropoff in air travel demand than the rest of the world and has seen a stronger recovery. A recent report by the International Air Transport Association says Far East and Asian markets "continue to show very strong growth."

Most major airlines reported losses in 2009 as travel demand slumped. The aircraft maker said Friday that it sees the airline industry recovering this year, followed by a return to profitability in 2011. That should lead to demand for new aircraft in 2012 and beyond, the company said.

Boeing, based in Chicago, will increase production of its 777 in mid-2011 to seven airplanes per month from five. The ramp-up was originally planned for early 2012. The 777 seats more than 300 people.

The 747-8, the newest version of Boeing's iconic jumbo jet, has been plagued by production problems. It took its first flight last month after being delayed for more than a year.

The passenger version, which carries more than 400 people, is scheduled to be delivered in the second quarter of 2011. Production will increase to two airplanes per month from 1.5 in mid-2012. The ramp-up had been scheduled for mid-2013.

Boeing lists 76 orders for the 747-8 freighter and 32 for the passenger version, with the vast majority from international customers.

Shares rose 42 cents to $71.29 in morning trading after rising earlier in the session to a 52-week high of $73.30.

Motorola posts 4Q profit but outlook is low

Motorola Inc. showed progress in its turnaround efforts Thursday but a disappointing profit forecast sent its shares sliding.

Motorola stock fell 73 cents, or 9.9 percent, to $6.67 in morning trading.

The shares are still more than double what they were trading for in March, as optimism has grown that Motorola can salvage its cell phone business. The first fruits of its new approach, the Cliq and Droid smart phones, went on sale in the fourth quarter.

Those phones were well received, and Motorola reporting shipping 2 million units. But overall cell phone sales were lower than expected, at 12 million units. Total revenue came to $5.7 billion, missing the average forecast from analysts of $5.9 billion, according to Thomson Reuters.

However, analysts did not appear to have taken into account that Motorola deferred $200 million in revenue from sales of smart phones, amortizing it instead over two years, in a new accounting step.

Looking ahead, Motorola said it expects a loss in the first quarter of 1 cent to 3 cents per share, excluding unusual items. Analysts expected a profit of 3 cents.

Motorola co-CEO Sanjay Jha said the loss would come from the planned launch of several new smart phones, with the attendant sales, marketing and support costs. At the same time, he expects smart phone sales to be down from the fourth quarter, when Verizon Wireless put a massive push behind the Droid.

Jha said sales of phones to be used on prepaid services were particularly weak in the fourth quarter. That could be bad news for Sprint Nextel Corp.'s Boost prepaid service, which uses Motorola phones exclusively. Sprint reports fourth-quarter results on Feb. 10.

The Cliq and Droid run Google Inc.'s Android software. Jha said Motorola will provide another phone to Google, which will sell it directly to consumers. Google started selling a phone made by Motorola rival HTC Corp. this month, marking the first time the Web company bypassed the carrier marketing channel.

Motorola's profits are still propped up by its other two divisions, which make things like police radios and cable set-top boxes, while the phone business loses money. However, Jha said he expects the phone business to become profitable in the fourth quarter this year as Motorola continues to shift its emphasis toward smart phones with more features.

Jha told analysts on a conference call that the phone division is at the beginning of that transition and "we have a lot of work ahead of us."

Motorola did not update investors on its long-running plans to split off the phone business. Those plans were put on hold in 2008, as sales kept cratering. The company says it's waiting for a stronger recovery.

In the fourth quarter, Motorola earned $142 million, or 6 cents per share, compared to a loss of $3.66 billion, or $1.61 per share, in the same period a year earlier. That loss was driven by a huge accounting charge.

Excluding unusual items, earnings in the most recent quarter were 9 cents per share. That was a penny higher than the average forecast from analysts, who typically exclude one-time charges from their estimates.

With overall sales of 12 million phones, Motorola has again lost its place as the world's fourth-largest maker to Sony Ericsson, which sold 14.6 million phones in the fourth quarter. Nokia Corp., LG Electronics Inc. and Samsung Electronics Co. all sell more.

NEW YORK (AP) — Rising prices for oil and other commodities prices pushed stocks up slightly in early afternoon trading Wednesday, but mixed earnings reports from retailers tempered the gains. The Dow Jones industrial average is still down 2.3 percent for the month.

The Dow rose 32 points, or 0.3 percent, to 12,512. The Standard & Poor's 500 index rose 7 points, or 0.5 percent, to 1,335.

Oil prices rose 4 percent to $100 a barrel because of a weaker dollar and after a Dept. of Energy report said inventories of crude oil did not rise last week as expected. Energy stocks in the S&P 500 rose nearly 2 percent, the most of the 10 industry groups in the index.

FedEx swings 4Q loss; issues slim guidance

FedEx says it swung to a loss in the fourth-quarter because of high fuel costs and issued an earnings guidance that is well below Wall Street's expectations.

FedEx sees 2009 earnings of $4.75 to $5.25 per share. Wall Street had predicted $5.92 per share. The package delivery company expects to earn 80 cents to $1 per share in the first-quarter. Analysts forecast $1.27 per share.

Last month's botched landing of a Russian capsule returning from the international space station was caused when an equipment module failed to separate from the capsule on time, a Russian space official said Wednesday.

The Soyuz TMA-11 craft carrying U.S. astronaut Peggy Whitson, Russian cosmonaut Yuri Malenchenko and South Korean bioengineer Yi So-yeon landed hundreds of kilometers off course when it bounced onto the steppes of northern Kazakhstan April 11.
